U.S.: Glass Still Half Full -- Worries about the U.S. economy have dominated news headlines since the start of 2016. There was weak headline growth in the 4th quarter of 2015, industrial production is falling, the global economy— particularly the BRIC nations (Brazil, Russia, India, China)— seems to be floundering, and commodity prices keep dropping. These worries appear to have spooked the financial markets leading to a broad selloff in the stock market—the market is off 10 percent from where it was at the end of last year. High-yield credit markets also are taking a beating and even bank sentiment is turning somewhat. Taken together, it may look like an economy that has lost the momentum it started to build early in 2015. However, if you put the headlines to one side and take a closer look at the data, it turns out that things are really no worse now than they were one year ago. While there are clearly issues that continue to interfere with the U.S. economy’s ability to get past a 3 percent pace of growth, on the other side of the equation, there are plenty of positive indicators suggesting that, at worst, 2016 will see growth remain in the 2 percent to 2.5 percent range.

Months of discussions recently culminated with the Legislature passing and the governor signing a California Chamber of Commerce-supported special session health plan funding proposal. SBX2 2 (E. Hernandez; D-West Covina) preserves critical funding for the state’s Medi-Cal program without undermining the affordability of commercial health care purchased by employers, families, and individuals. In a news release announcing the signing of SBX2 2 and accompanying bills, Gov. Edmund G. Brown Jr. said the legislation will result in a net tax cut, maintain more than $1 billion in critical federal funds, reduce debt by more than $400 million and direct about $300 million in new funding to help persons with developmental disabilities.

Protecting employees from motor vehicles crashes could be a profitable investment for U.S. businesses, according to a new report released recently by the Network of Employers for Traffic Safety (NETS). In 2013, U.S. traffic crashes cost employers $47.4 billion in direct crash-related expenses, which includes medical care, liability, lost productivity and property damage. The study showed that employers could control costs by promoting safe driving habits, including seat belt usage and the elimination of speeding, drunk driving and distracted driving, whether or not employees are on the clock.

The Short-Term Energy Outlook (STEO) released on March 8 from the U.S. Energy Information Administration (EIA) forecasts that North Sea Brent crude oil prices will average $34 per barrel (b) in 2016 and $40/b in 2017, $3/b and $10/b lower, respectively, than expected in last month’s STEO. EIA expects that West Texas Intermediate (WTI) prices will average the same as Brent in 2016 and 2017, based on the assumption that the two crudes will compete in the U.S. Gulf Coast refinery market during the forecast period, with similar transportation differentials from their respective pricing points to that market. The current value of futures and options prices contracts continue to suggest high uncertainty in the price outlook.

Joel Fox, editor of Fox & Hounds and president of the Small Business Action Committee, recently commented on Senate President Pro Tem Kevin de León's desire to add three commissioners to the South Coast Air Quality Management District board so as to tip the board to a more favorable perspective from his point of view. Fox is not in favor of de León's idea, stating that, "It is rather unseemly for a democratic government to readjust the size of a legally constituted body simply because you don’t like the outcome of that body’s deliberations. There are processes for overturning board actions either legislatively or by changing the board members through established procedures. For de León, changing rules by adding sympathetic members to benefit his causes makes it appear a power grab. Ironically, that’s the way opponents of the currently constituted board describe its legal ascension to power. A true power grab occurs when rules are changed to benefit the rule changers."

The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Lighter and older, heavier trucks must be replaced starting Jan. 1, 2015. By Jan. 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel-fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds.

What's New: The Truck and Bus Reporting System Now Available for 2016 (Dec. 10, 2015). From this site, you can report your company and vehicle information. We encourage fleets to report early, before the Jan. 31, 2016, reporting deadline. This area of the Off-Road Mobile Sources website pertains to off-road, large spark-ignition (LSI) equipment greater than 25 horsepower, including farm, construction and industrial equipment, powered by gasoline and liquefied petroleum gas (LPG) and other alternate fuels. Typical applications that use LSI engines include forklifts, specialty vehicles, airport service vehicles, large turf-care equipment, portable generators and a wide array of other agricultural, construction and general industrial equipment. The U.S. EPA has sole authority to control new farm and construction equipment under 175 horsepower.

Posted Sept. 25, 2015: Public Workshops to Discuss Proposed Amendments to the Off-Road Large Spark-Ignition Engine Fleet Regulation
Staff is developing a proposal to require reporting and labeling, similar to the existing In-Use Off-Road Diesel-Fueled Fleets Regulation, for equipment covered by the LSI Fleet Regulation. Additional minor clarifications are also being proposed. The proposed amendments are critical to providing needed inventory updates, facilitating uniform compliance and identifying incentive opportunities. Staff is also interested in hearing from affected stakeholders on alternatives to achieving these same objectives. For more information, please contact Todd Sterling, air pollution specialist, at (916) 323-2397. To be apprised of public workshops or other opportunities for public input, please subscribe to the regulation mailing list.

The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The regulations Title 13 CCR, sections 2180-2189 for HDVIP and Title 13 CCR, sections 2190-2194 for PSIP, which govern these programs, were last amended in 2013.

The HDVIP program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering and for engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Tests are performed by ARB inspection teams at border crossings, CHP weigh stations, fleet facilities and randomly selected roadside locations. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation.

The Truck and Bus Regulation will reduce diesel-exhaust emissions from privately owned and federal government diesel trucks and buses. Privately and publicly owned school buses have different requirements and do not need to be reported. This CARB site has the Truck Regulations Upload and Compliance Reporting System (TRUCRS).

Who Needs to Report for 2016? The reporting period for 2016 compliance closes Jan. 31, 2016. Those who had opted-in to mileage-based extension for 2015 must report end-of-year odometer readings and confirm whether you will continue to use the same option in 2016. By reporting, owners can take advantage of flexibility options for heavy-duty diesel powered vehicles subject to the Truck and Bus regulation.
