The White House announced on July 2 that it was delaying implementation of the employer mandate portion of the Patient Protection and Affordable Care Act until 2015. The U.S. Treasury also issued a notice of the delay. The mandate originally was scheduled to begin January 1, 2014.

The July 2nd CalChamber Alert newsletter reported that two California Chamber of Commerce-opposed "job killer" bills that will place costly workplace mandates on employers passed policy committees in the second house on June 26. AB 10 unfairly imposes an automatic $2 increase in minimum wage over the next five years that will continue to increase costs on employers of all sizes, regardless of other economic factors or costs that California employers are struggling with to sustain their business. SB 404 makes it virtually impossible for employers to manage their employees and exposes them to a higher risk of litigation by expanding the Fair Employment and Housing Act (FEHA) to include a protected classification for any person who is, perceived to be, or associated with an individual who provides medical or supervisory care to a listed family member.

The U.S. Energy Information Administration (EIA) recently released its annual data series tracking how crude oil reaches the refinery gate. Not surprisingly, the 2012 data show heightened reliance on crude receipts via barge, truck and rail. There has been much discussion about the rise in U.S. crude oil production and the resulting overhang in inventories at Cushing, Oklahoma and elsewhere in the midcontinent because of pipeline infrastructure that has not kept pace with burgeoning domestic crude oil supply. The supply-pipeline mismatch is encouraging market participants to increasingly rely on alternative transportation options. Consumer Reports recently reported that the Ford F-250 pickup truck has replaced the Cadillac Escalade as the vehicle with the highest theft rate for 2010–2012, according to a new report from the Highway Loss Data Institute (HLDI), a division of the Insurance Institute for Highway Safety. New anti-theft technology on the Escalade and its waning popularity are two reasons cited for its fall from first to sixth place on the list. Clearly, pickup trucks and SUVs are popular among thieves. The F-250 has a claim frequency of nearly six times the average of all vehicles. However, thefts are declining due to ignition immobilizers, which prevent thieves from hot-wiring a vehicle. For the 2012 model year, 89 percent of vehicles had this technology; it is standard on most cars and SUVs, but not on as many pickup trucks.

The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The regulations, title 13 CCR, sections 2180-2189 for HDVIP, and title 13 CCR, sections 2190-2194 for PSIP, governing these programs were last amended in 2013. The HDVIP program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering, and engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Tests are performed by ARB inspection teams at border crossings, CHP weigh stations, fleet facilities, and randomly selected roadside locations. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation.

Owners or operators of portable engines and certain other types of equipment can register their units under the Air Resources Board's (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts. As of January 1, 2013, the Portable Engine Airborne Toxic Control Measure (ATCM) fleet standards went into effect. The ATCM requires owners of portable engines to submit a statement of compliance signed by a Responsible Official to the Air Resources Board by March 1, 2013. In addition to the statement of compliance, a summary that identifies each portable engine in the fleet and the associated emission rate (g/bhp-hr) must be included.

The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Heavier trucks must be retrofitted with PM filters beginning January 1, 2012, and older trucks must be replaced starting January 1, 2015. By January 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. What's New? Advisory on Manufacturer Delays (July 9, 2013): Staff has posted Mail-Out 13-15, which clarifies requirements for the manufacturer delay extension and how compliance is determined when the fleet owner orders equipment four months prior to the compliance deadline.

Posted August 13, 2012: ARB has received U.S. Environmental Protection Agency authorization to enforce the Large Spark-Ignition Engine Fleet Requirements Regulation (LSI Fleet Regulation), including the fleet average emission level standards. Enforcement Advisory 441 announces that all provisions of the LSI Fleet Regulation are enforceable and that ARB intends to commence enforcement of all its requirements. The calculator allows fleets to experiment with different turnover, repower, and retrofit strategies to plan for compliance with the in-use off-road diesel vehicle regulation.

The Truck and Bus Regulation will reduce diesel exhaust emissions from privately owned and federal government diesel trucks and buses. Privately and publicly owned school buses have different requirements and do not need to be reported.
