The San Francisco Bay Area and Vintage Territories held their annual Holiday Parties at Harry’s Hofbrau and Cattlemans Restaurants. (Click on "Learn More" to see photos from these parties.) Great meals were had by all, and festivities included fun raffles with items from CRA and from many vendors -- thank you, vendors! Discussions and announcements included the 2016 Western Rental Rally schedule, registration, seminars, and optional events, which include the Opening Cocktail Party and the CRA Crawl on the Linq. To date, we have 300 vendor booths, with party and event, construction, and industrial products, and service providers. Los Angeles — The U.S. Environmental Protection Agency and U.S. Customs and Border Protection announced on Dec. 9 that $94,700 in fines and more than 1,394 items, including engines, scooters and ATVs, were recently seized, exported out of the country, or destroyed. This was the latest result of their continued joint operations, at the ports of LA, Long Beach, and Oakland, targeting foreign-made vehicles and equipment without proper emission controls, as well as illegal pesticides, imported into the United States in violation of federal law. EPA estimates that the noncompliant vehicles and engines in its enforcement cases announced recently would have emitted at least 215,000 pounds of nitrogen oxide (NOx) and hydrocarbons (HC) per year.

The California Chamber of Commerce and a coalition of Western farmers, ranchers and businesses, as well as urban, suburban and rural residents, are urging members of a U.S. Senate committee to put aside partisan differences and work together to produce comprehensive drought legislation that can be passed and signed into law this year. In its letter to the U.S. Senate Energy and Natural Resources Committee, the coalition said it is confident the committee can draw upon a strong foundation to create this legislation.

The California Chamber of Commerce is presenting handy summaries of new legislation taking effect in 2016 that will affect the day-to-day operations of California employers. The summaries appear in a CalChamber white paper, available to download at www.calchamber.com/newlaws2016. Some of these new laws make important changes to existing state law. Other mandates make small changes to different parts of existing law or may affect only certain types of employers, such as employers with piece-rate workers. The CalChamber also reminds employers that the minimum wage increases on Jan. 1, 2016, to $10 an hour. The increase is not a new law, but is the last mandatory increase from the legislation signed into law in 2013.

The Board of Directors of the Scaffold & Access Industry Association (SAIA) is pleased to announce the appointment of R. Granville Loar to the position of executive director of the association. Loar began his work with SAIA in July 2009 as the director of education & training. During the six years under Loar's leadership, the training department saw a 151 percent increase in the number of students participating in SAIA courses, as well as 125 percent department revenue growth. He has been functioning as interim executive director since the position vacancy in mid-October 2015. Prior to joining the SAIA, Loar held the position of executive director for a similarly structured international association.

The Short-Term Energy Outlook (STEO) released on Dec. 8 forecasts non-OPEC crude oil and other liquids production to grow by 1.2 million barrels per day (b/d) in 2015, and then decline by 0.4 million b/d in 2016, which would be the first annual decline in non-OPEC production since 2008. The shift in expectation from non-OPEC production growth to declines in 2016 is mostly because of declines in U.S. onshore and North Sea production. Non-OPEC production growth in 2015 is largely attributable to investments committed to projects before the oil price decline that began in mid-2014. Redirection of investment away from exploration toward currently producing fields has also helped maintain or increase production levels in other non-OPEC countries. This strategy has helped maintain production levels in the short term, but it will likely result in lower future production in areas that depend on continued exploration successes for output growth.

Truck and Bus Regulation: On-Road, Heavy-Duty Diesel Vehicles (In-Use) Regulation
The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Lighter and older, heavier trucks must be replaced starting Jan. 1, 2015. By Jan. 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel-fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds.
What's New: The Truck and Bus Reporting System Now Available for 2016 (Dec. 10, 2015). The Truck and Bus regulation reporting system is now available for fleet owners to report diesel vehicle information for 2016 at no cost. From this site, you can report your company and vehicle information. We encourage fleets to report early, before the Jan. 31, 2016, reporting deadline. If you have previously reported, you can access your account by using your username and password.

This category does not include compression-ignition engines, watercraft or recreational vehicles. On July 26, 2007, the Air Resources Board (ARB) adopted a regulation to reduce diesel particulate matter (PM) and oxides of nitrogen (NOx) emissions from in-use (existing), off-road, heavy-duty diesel vehicles in California.

A Fleet Average Calculator for Small Fleets has been made available for public use. The Small Fleet Average Calculator is for small-sized off-road fleets (2,500 or less total horsepower) and covers all compliance years. The calculator is available here. Fleet owners utilizing the calculator are advised to first read the User Guide in order to familiarize themselves with the calculator.

The FAQs on Verified Diesel Emission Control Strategy (VDECS), VDECS Credit, Adding Vehicles, and Written Idling Policy Guidelines have been updated for clarification and to include guidance for fleets with Cleaire devices, along with the DOORS User Guides on How to Report Engine Repowers, How to Report Vehicles Which Have Been Sold or Retired, and How to View Equipment Identification Numbers (EINs) and Print or Export Vehicle and Engine Data to be consistent with DOORS updates. These updated documents are available in the Knowledge Center.

This area of the Off-Road Mobile Sources website pertains to off-road, large spark-ignition (LSI) equipment greater than 25 horsepower, including farm, construction and industrial equipment, powered by gasoline and liquefied petroleum gas (LPG) and other alternate fuels. Typical applications that use LSI engines include forklifts, specialty vehicles, airport service vehicles, large turf-care equipment, portable generators and a wide array of other agricultural, construction and general industrial equipment. The U.S. EPA has sole authority to control new farm and construction equipment under 175 horsepower.

Staff is developing a proposal to require reporting and labeling, similar to the existing In-Use Off-Road Diesel-Fueled Fleets Regulation, for equipment covered by the LSI Fleet Regulation. Additional minor clarifications are also being proposed. The proposed amendments are critical to providing needed inventory updates, facilitating uniform compliance, and identifying incentive opportunities. Staff is also interested in hearing from affected stakeholders on alternatives to achieving these same objectives. The ARB's Heavy-Duty Vehicle Inspection Program and Periodic Smoke Inspection Program were adopted into law in 1988 to control excessive smoke emissions and tampering from heavy-duty diesel trucks and buses. The regulations Title 13 CCR, sections 2180-2189 for HDVIP and Title 13 CCR, sections 2190-2194 for PSIP, which govern these programs, were last amended in 2013.

The HDVIP program requires heavy-duty trucks and buses to be inspected for excessive smoke and tampering and for engine certification label compliance. Any heavy-duty vehicle traveling in California, including vehicles registered in other states and foreign countries, may be tested. Tests are performed by ARB inspection teams at border crossings, CHP weigh stations, fleet facilities and randomly selected roadside locations. Owners of trucks and buses found in violation are subject to minimum penalties starting at $300 per violation.

The Truck and Bus Regulation will reduce diesel-exhaust emissions from privately owned and federal government diesel trucks and buses. Privately and publicly owned school buses have different requirements and do not need to be reported. This CARB site has the Truck Regulations Upload and Compliance Reporting System (TRUCRS).

Who Needs to Report for 2016? The reporting period for 2016 compliance closes Jan. 31, 2016. Those who had opted-in to mileage-based extension for 2015 must report end of year odometer readings and confirm whether you will continue to use the same option in 2016. By reporting, owners can take advantage of flexibility options for heavy-duty diesel powered vehicles subject to the Truck and Bus regulation.

Owners or operators of portable engines and certain other types of equipment can register their units under the Air Resources Board's (ARB) Statewide Portable Equipment Registration Program (PERP) in order to operate their equipment throughout California without having to obtain individual permits from local air districts.

Portable Diesel Engine Airborne Toxic Control Measure
On Jan. 1, 2013, the Portable Engine Airborne Toxic Control Measure (ATCM) fleet emission standards went into effect. The ATCM required owners of portable engines to submit a Fleet Compliance Report to the Air Resources Board by March 1, 2013. The next Fleet Compliance Report will be due March 1, 2017.
